1. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2. Description of Service

RepAI is an AI-powered platform that transforms your content into multiple optimized formats for various platforms. The Service is provided on a subscription basis with free and paid tiers. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must provide accurate and complete information when creating an account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree NOT to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Create content that infringes on the intellectual property rights of others.
• Produce misleading, deceptive, or fraudulent content (e.g., deepfakes, impersonation).
• Distribute spam, malware, or phishing content.
• Attempt to reverse-engineer, decompile, or extract source code from the Service.
• Use automated means (bots, scrapers) to access the Service beyond its intended API.
• Circumvent rate limits, usage quotas, or security measures.
• Resell, sublicense, or redistribute the Service without written authorization.

We reserve the right to suspend or terminate accounts that violate this policy, without refund.

• Paid plans are billed on a recurring monthly basis via Stripe.
• Prices are displayed in your local currency where available. All prices are inclusive of applicable taxes unless stated otherwise.
• You may cancel your subscription at any time. Access continues until the end of your current billing period.
• We do not offer automatic refunds. Refund requests are handled on a case-by-case basis within 14 days of purchase.
• We reserve the right to change pricing with at least 30 days' notice. Existing subscribers will be notified before any price change takes effect.
• Free tier usage is subject to monthly credit limits, which may be adjusted at our discretion.

7. Affiliate Program

RepAI offers an affiliate program that allows users to earn commissions by referring new paying subscribers. By participating, you agree to:

• Promote RepAI honestly and transparently, without misleading claims.
• Disclose your affiliate relationship as required by applicable advertising laws (e.g., FTC guidelines).
• Not use spam, paid ads on our brand name, or deceptive tactics to generate referrals.
• Accept that commissions may be revoked in case of fraud, chargebacks, or violations of these Terms.

Commission rates and terms may be modified with 30 days' notice.

8. AI-Generated Content Disclaimer

• AI-generated content may contain errors, inaccuracies, or biases.
• You are solely responsible for reviewing, editing, and publishing AI-generated content.
• RepAI does not guarantee that AI outputs will be suitable for any particular purpose.
• You are responsible for ensuring that published content complies with applicable laws and platform terms of service.
• RepAI is not liable for any consequences arising from the use or publication of AI-generated content.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service interruptions.

10. Limitation of Liability

To the maximum extent permitted by applicable law, RepAI and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service. Our total aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless RepAI from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) content you submit or publish through the Service.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of France. Any disputes arising from these Terms or the Service shall first be submitted to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the competent courts of Paris, France. Nothing in these Terms limits your rights under mandatory consumer protection laws of your country of residence.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes at least 30 days in advance via email or in-app notification. Continued use of the Service after the effective date of changes constitutes acceptance. If you do not agree with the updated Terms, you must stop using the Service.
